Who is responsible for detecting if asbestos is present, a contractor of a project or a homeowner?
My project construction stopped by the Department of Environmental Protection in New York City after a neighbor complained of asbestos. The Contractor shall not realize that asbestos is present and was not the architect, who at one point stated that the asbestos is absent. I as the owner was not aware that asbestos is present and confidence contractor or architect to determine if the substance is present. The contractor is responsible? It is one that changes randomly asbestos insulation in the house and they do not account of what it was asbestos. The project has been ordered to be suspended by the DEP, New York and has delayed the renovation for a couple of weeks and quantified approximately $ 10,000 (including fees).
Unfortunately for you, you own the property and cleaning is your responsibility. If the architect or contractor found asbestos in the beginning, you had to pay for disposal. From your description, your mistakes can cost anything beyond the cost of disposal. Do not you hate when you get hit really hard in the pocket?
